Data Collaboration Agreement

The Primary Health Service gives permission for WQPHN to collect, store, use and share information (Primary Health Service Information and Primary Health Service Data) with relevant Essential Partner Organisations, Approved Research Institutions and parties with a data collaboration agreement with WQPHN, for the purpose of relevant WQPHN services and activities.

Definitions

Primary Health Service Information

  • Primary Health Service contact information to maintain public service directories and program directories such as HealthPathways, HealthDirect etc;

  • Details of Primary Health Service software specifications and integrations including secure messaging and other digital health products and relevant IT support contacts;

  • Primary Health Service identification numbers for regional, state and federal government programs and compliance reporting requirements for example, Practice Incentives, COVID support programs, Accreditation status, provider and renewal dates;

  • Workforce information, staff roles, numbers and FTE, employee contacts including name, role, work email, daytime phone and relevant contact details;

  • Residential Aged Care Facility (RACF) coverage details; and

  • Employee information pertaining to education and event registration.

Primary Health Service Data

Includes de-identified (row level-pseudonymised), geotagged-patient data (demographic data, diagnoses, medications, allergies, diagnostic reports, and Medicare item numbers) WQPHN Services and Activities:

  • Population health and service linkage, planning and analysis;

  • Targeting support, training, and troubleshooting activities and the development of resources by WQPHN for use by the Primary Health Service and others;

  • Data driven quality improvement activities with the Primary Health Service by using unit level and aggregated patient data;

  • Approved research purposes;

  • Inform policy and planning at regional, state, and federal levels;

  • Evaluate the impact of support, resources and services provided by WQPHN and Essential Partner Organisations; and

  • Reporting required by regional, state, and federal government programs.

Practice Incentive Payment Information

  • Registration details as specified by the Australian Government Department of Health;

  • Subset of Primary Health Service Data as set out in the PIPQI Technical Data Specification;

  • Secure Upload Portal user registration information as set out in the End User Licence Agreement; and

  • Other information as required to meet reporting obligations as Regional Data Custodians as set out in the Practice Incentives Program Eligible Data Set Data Governance Framework. Data Analysis Tools

Approved Research Institution

  • Research institution undertaking activities with ethics approval and managing research activities in accordance with published guidance material and the Australian Code for the Responsible Conduct of Research, 2018 as assessed and approved by WQPHN.

Term/Termination

  • The term of this agreement begins on the date signed and will continue until terminated by either party with one month’s written notice or immediately in the event of insolvency or breach of legislative obligations as set out in this agreement. This Agreement may only be amended following the agreement in writing by both Parties.

  • See Exclusions (below). 

Responsibilities

The PHN is responsible for and will:

  • Collect, store, use, share and destroy information in alignment with obligations outlined in the Australian Privacy Principles (The Privacy Act 1988 cth.), The Notifiable Data Breaches Act 2017, and relevant legislation;

  • Take necessary steps to ensure that Essential Partner Organisations and parties with a data collaboration agreement with WQPHN will store, use and destroy shared data in alignment with obligations outlined in the Australian Privacy Principles (The Privacy Act 1988 cth.) and related legislation;

  • Carry out obligations of data custodian of the received information and will ensure through best practice data governance policy and framework that the storage of the data is in accordance with the appropriate levels of security and in accordance with all relevant legislation;

  • Carry out obligations of regional data custodians as set out in the Practice Incentives Program Eligible Data Set Data Governance Framework (where the Primary Health Service is registered and reporting PIPQI measures to WQPHN);

  • Facilitate the installation of interfacing data analysis tools at no expense to the Primary Health Service;

  • Supply the Primary Health Service with Data Reports in accordance with the data collection schedule. Upon request, WQPHN may support the Primary Health Service to improve data quality, patient care and streamline processes. This support may be offered face to face or via remote access;

  • Use the Primary Health Service data in a manner that will not allow for the re-identification of any patient of the Primary Health Service but may link data sets with the Primary Health Service data for greater analysis capability;  

  • Use all reasonable care and comply with specifications of the data analysis tools and incur no liability to the Primary Health Service for any loss incurred in relation to installation, use or removal of the data analysis tools; and

  • Warrant that it has and will continue to comply with relevant privacy laws in relation beyond the term of this agreement.

The Primary Health Service is responsible for and will:

  • Collect, store, use, share and destroy information in alignment with obligations outlined in the Australian Privacy Principles (The Privacy Act 1988 cth.), The Notifiable Data Breaches Act 2017, and relevant legislation;

  • Provide and update WQPHN with changes to Primary Health Service information;

  • Provide access to the Primary Health Service premises and technology systems including the server for purposes connected to the installation, use, training and support of the data analysis tools for Primary Health Service use;

  • Submit row level-pseudonymised (de-identified) Primary Health Service data to WQPHN or a WQPHN approved research institution via the nominated data analysis tools as required in the data collection schedule;

  • Provide WQPHN additional data extractions outside of the data collection schedule to meet reporting requirements of WQPHN programs that the Primary Health Service is registered for;

  • Make a commitment to data quality and work with WQPHN to achieve outcomes as per the Primary Health Service needs;

  • Provide privacy notice and document consent obtained for the collection and sharing of personal and sensitive information from clients; 

  • Only use and meet obligations set out in End User Licence and other agreements of Data Analysis Tools licenced by WQPHN and provided to the Primary Health Service. Details in Primary sense Data Sharing Agreement and SLA and;

  • Agree to have the Data Analysis Tools licenced by WQPHN uninstalled if the Primary Health Service chooses not to participate in data collaboration and quality improvement activities and this data collaboration agreement is terminated.

Exclusions

The WQPHN is not responsible for:

  • Training, support, and data extracted by Third Party software applications and integrations not provided by WQPHN;

  • All losses, costs (including reasonable solicitor and client costs), expenses, demands or liability caused by the Primary Health Service’s breach of this agreement and breach of intellectual property rights and obligations as outlined in end user agreements of the provided data analysis tools; and

  • Any non-performance, failure, loss, alteration or corruption of software or Primary Health Service Data or other aspect of data analysis tools as outlined in end user agreements of the provided data analysis tools.
